1. Agreement to Terms

By accessing our website or using our services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

These terms apply to all visitors, users, and others who access or use our horological services.

2. Definitions

  • "Service" refers to watch repair and maintenance services provided by Clockwork Elite
  • "Client" or "You" means any person or entity using our services
  • "Timepiece" refers to any mechanical watch submitted for service
  • "We," "Us," "Our" refers to Clockwork Elite
  • "Agreement" means these Terms of Service

3. Service Terms

3.1 Service Acceptance

We reserve the right to refuse service on any timepiece for any reason, including but not limited to: lack of appropriate parts, complexity beyond our technical capability, or counterfeit items.

3.2 Service Estimates

All service estimates are provided after initial assessment. Estimates are valid for 30 days. If additional work is discovered during service, we will contact you for approval before proceeding.

3.3 Service Duration

Service timelines are estimates based on typical conditions. Actual completion may vary due to parts availability, movement complexity, or unforeseen technical issues. We will communicate any delays promptly.

3.4 Payment Terms

Payment is due upon service completion before timepiece return. We accept major credit cards and electronic transfers. Service fees must be paid in full before release of serviced items.

4. Client Responsibilities

  • Provide accurate information about timepiece condition and service history
  • Disclose any previous repair attempts or modifications
  • Respond to communication requests regarding service decisions within 7 business days
  • Collect timepiece within 60 days of service completion notification
  • Pay all service fees as agreed

5. Warranties and Disclaimers

5.1 Service Warranty

We provide a 12-month warranty on all performed service work and replaced components under normal wearing conditions. The warranty covers defects in workmanship and component failures but does not cover:

  • Damage from impacts or drops
  • Water damage from external seal failure
  • Damage from unauthorized service by others
  • Normal wear and tear
  • Cosmetic issues not related to our service

5.2 Pre-Existing Conditions

We are not responsible for pre-existing conditions not disclosed at time of service intake or not discovered during initial assessment.

5.3 Limitation of Liability

Our total liability for any claim related to our services is limited to the amount paid for the specific service in question. We are not liable for any indirect, incidental, or consequential damages.

6. Abandoned Property

Timepieces not collected within 90 days of service completion notification will be considered abandoned. We reserve the right to:

  • Charge storage fees of $10 CAD per week after 90 days
  • Dispose of abandoned items after 120 days
  • Apply service fees owed against the value of abandoned items

7. Intellectual Property

All content on our website, including text, graphics, logos, and images, is the property of Clockwork Elite and protected by Canadian copyright laws. You may not reproduce, distribute, or create derivative works without written permission.

8. Privacy

Your use of our services is also governed by our Privacy Policy. Please review our Privacy Policy to understand our data practices.

9. Dispute Resolution

9.1 Informal Resolution

If you have any concerns about our services, please contact us directly. We will make good faith efforts to resolve disputes informally.

9.2 Governing Law

These terms are governed by the laws of British Columbia, Canada. Any disputes will be resolved in the courts of British Columbia.

9.3 Arbitration

For disputes exceeding $5,000 CAD, both parties agree to attempt mediation before pursuing litigation. Mediation costs will be shared equally.

10. Service Modifications

We reserve the right to modify or discontinue services at any time without prior notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of services.

11. Force Majeure

We are not liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, labor disputes, government actions, or supply chain disruptions.

12. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms of Service will otherwise remain in full force and effect.

13. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes constitutes acceptance of the modified terms.

Material changes will be communicated via email to clients with active service assignments.
